There is no need for the courts to make such a judgement, society has eyes and ears, with the internet and mass media situations can be delt with as they come. Why would you think a judicial court be superior to society in this arena?

In our current economic system others have monopolized access to the tools that allow creation as well as exposure, in exchange for the individual's IP. This means that those who have no qualifications other than being really fucking rich are directing the creative process instead of those who actually do the creating.

I think to an extent giving credit where credit is due should really apply to IP more than anything else. Like say someone invents something- that person has the right to be recognized as the original inventor and if somebody wants to buy the idea well that's up to them.

If you raise costs for producers (thus for consumers) then IP laws are the way to go.

This was a huge argument in college played out over multiple courses. The dilemma of English major hippies is that although they love open sourcing, they hate the idea that they won't get paid for their shit.

We ended up thinking there should be a time limit. You have a decade and a half to cash in on your work. If people's struggles couldn't be capitalized on, they'd never make anything new.
